{"id":46066,"date":"2014-08-06T08:00:58","date_gmt":"2014-08-06T08:00:58","guid":{"rendered":"http:\/\/mostafa.openonline.co.uk\/?guid=806400b8cbc9881e650ba0ee6e2c50f1"},"modified":"2014-08-06T08:00:58","modified_gmt":"2014-08-06T08:00:58","slug":"press-release-press-freedom-boosted-by-new-right-to-report","status":"publish","type":"post","link":"https:\/\/mostafa.openonline.co.uk\/?p=46066","title":{"rendered":"Press release: Press freedom boosted by new &#8216;right to report&#8217;"},"content":{"rendered":"<div class=\"govspeak\">\n<p>In a boost for local democracy and the independent free press, councils in England were brought into the 21st century today (6 August 2014) after Local Government Secretary, Eric Pickles, signed a Parliamentary order allowing press and public to film and digitally report from all public meetings of local government bodies. This \u2018right to report\u2019 updates a law passed by Margaret Thatcher as a backbench MP.<\/p>\n<p>Following the passage of both primary and secondary legislation, the move opens councils\u2019 digital doors, covering broadcasters, national press, local press, bloggers and hyper-local journalists and the wider public. The new law aims to end active resistance amongst some councils to greater openness. Councils have even called the police to arrest people who tried to report, tweet or film council meetings, or claimed spurious \u2018health and safety\u2019 or \u2018reputational risks\u2019 to digital reporting.<\/p>\n<p>This new law builds on Margaret Thatcher\u2019s successful Private Members\u2019 Bill from 1960 which allowed for the written reporting of council meetings by the press. The new rules will apply to all public meetings, including town and parish councils and fire and rescue authorities.<\/p>\n<p>Local Government Secretary, Eric Pickles, said: <\/p>\n<blockquote>\n<p>Half a century ago, Margaret Thatcher championed a new law to allow the press to make written reports of council meetings. We have updated her analogue law for a digital age.<\/p>\n<p>Local democracy needs local journalists and bloggers to report and scrutinise the work of their council, and increasingly, people read their news via digital media. The new \u2018right to report\u2019 goes hand in hand with our work to stop unfair state competition from municipal newspapers &#8211; together defending the independent free press.<\/p>\n<p class=\"last-child\">There is now no excuse for any council not to allow these new rights. Parliament has changed the law, to allow a robust and healthy local democracy. This will change the way people see local government, and allow them to view close up the good work that councillors do.<\/p>\n<\/blockquote>\n<h2 id=\"further-information\">Further information<\/h2>\n<h3 id=\"new-rights\">New rights<\/h3>\n<p>The government has published a <a href=\"https:\/\/www.gov.uk\/government\/publications\/open-and-accountable-local-government-plain-english-guide\">plain English guide<\/a> of practical information on how the public can exercise their new rights, and what they should expect from their local government bodies. <\/p>\n<p>The <a rel=\"external\" href=\"http:\/\/www.legislation.gov.uk\/uksi\/2014\/2095\/contents\/made\">Openness of Local Government Regulations 2014<\/a>, which apply to England, give rights to members of the press and public to:<\/p>\n<ul>\n<li>use modern technology and communication methods such as filming, audio-recording, blogging and tweeting to report the proceedings of the meetings of their councils and other local government bodies<\/li>\n<li>see information relating to significant decisions made outside meetings by officers acting under a general or specific delegated power<\/li>\n<\/ul>\n<h3 id=\"case-studies\">Case studies<\/h3>\n<ul>\n<li>a councillor in Thanet was removed by the police for trying to film a council meeting discussing airport expansion<\/li>\n<li>Wirral Council said filming a planning committee would compromise \u2018health and safety\u2019.<\/li>\n<li>Tower Hamlets Council barred a 71 year old resident from filming due the risk of \u2018reputational damage\u2019 to the authority<\/li>\n<li>Keighley Town Council blocked residents filming as it would amount to a \u2018breach of standing orders\u2019<\/li>\n<li>Bexley Council said audio and visual filming would breach its \u2018agreed protocol\u2019<\/li>\n<li>Stamford Town Council placed a ban on journalists tweeting from meetings due to the risk of them \u2018not accurately portraying a debate\u2019<\/li>\n<li>a blogger in Huntingdonshire was removed by police for filming, and has advised fellow bloggers to \u2018be prepared for the police to be called and the possibility of arrest\u2019<\/li>\n<\/ul>\n<h3 id=\"margaret-thatchers-1960-law\">Margaret Thatcher\u2019s 1960 law<\/h3>\n<p>The <a rel=\"external\" href=\"http:\/\/www.legislation.gov.uk\/ukpga\/Eliz2\/8-9\/67\/contents\/enacted\">Public Bodies (Admission to Meetings) Act 1960<\/a> was a successful Private Members\u2019 Bill by new backbencher, Margaret Thatcher MP;
