{"id":52259,"date":"2015-01-08T13:07:56","date_gmt":"2015-01-08T13:07:56","guid":{"rendered":"http:\/\/mostafa.openonline.co.uk\/?guid=88a9a8e2041a42fdd09249ee481e41ca"},"modified":"2015-01-08T13:07:56","modified_gmt":"2015-01-08T13:07:56","slug":"news-story-crime-news-how-to-avoid-rejections-on-legal-aid-applications","status":"publish","type":"post","link":"https:\/\/mostafa.openonline.co.uk\/?p=52259","title":{"rendered":"News story: Crime news: how to avoid rejections on legal aid applications"},"content":{"rendered":"<div class=\"govspeak\">\n<p>We are rejecting a large number of criminal legal aid applications because the assessment information we need is missing.<\/p>\n<p>You can avoid a lot of issues by using the CRM14 eForm instead of the old paper form. This is now being rolled out across England and Wales.<\/p>\n<p>The eForm has the benefit of helping to ensure that all the information is completed before the application is made and reduces the potential for rejected applications. <\/p>\n<p>In the meantime, here are some tips to help avoid this problem:<\/p>\n<h3 id=\"incomplete-form\">Incomplete form<\/h3>\n<p>Make sure all the questions are answered. If they haven\u2019t been answered and the information is needed to process the application then the form will have to be returned.<\/p>\n<p>Examples of missing information include: <\/p>\n<ul>\n<li>evidence of income<\/li>\n<li>bank account details<\/li>\n<li>whether the applicant is in custody and has a partner<\/li>\n<\/ul>\n<p>These examples are covered in more detail below.<\/p>\n<h3 id=\"missing-income-evidence\">Missing income evidence<\/h3>\n<p>Where the applicant has a declared income, and they are not remanded in court custody, they need to provide evidence of this. <\/p>\n<h3 id=\"fully-complete-the-declaration-section\">Fully complete the declaration section<\/h3>\n<p>The declarations for the applicant, their partner, and the defence representative need to be completed by all the relevant parties.<\/p>\n<p>In particular the defence representative must tick 1 only of the 2 boxes above their signature to confirm their status. The form should be signed and dated. <\/p>\n<h3 id=\"duplicate-applications\">Duplicate applications<\/h3>\n<p>Check whether an application has already been submitted for your client as we sometimes receive more than one application for a particular offence.<\/p>\n<p>It is worthwhile noting that it is not just different defence organisations that submit applications for the same client \u2013 we often receive duplicate applications from within the same firm.<\/p>\n<h3 id=\"clarify-how-the-defendanttheir-partner-are-supporting-themselves\">Clarify how the defendant\/their partner are supporting themselves<\/h3>\n<p>For magistrates\u2019 court applications where no income is declared, or an applicant\u2019s income is less than their outgoings, we ask that they provide information about how they are supporting themselves.
