{"id":54754,"date":"2015-03-05T14:11:00","date_gmt":"2015-03-05T14:11:00","guid":{"rendered":"http:\/\/mostafa.openonline.co.uk\/?guid=9662f14689d52f7543d0407f585fe5c8"},"modified":"2015-03-05T14:11:00","modified_gmt":"2015-03-05T14:11:00","slug":"news-story-crime-news-new-disclosure-process-for-unused-material-in-summary-cases","status":"publish","type":"post","link":"https:\/\/mostafa.openonline.co.uk\/?p=54754","title":{"rendered":"News story: Crime news: new disclosure process for unused material in summary cases"},"content":{"rendered":"<div class=\"govspeak\">\n<p>A new, more effective disclosure process is being made available to defence practitioners in summary cases.<\/p>\n<p>This was a key recommendation of the Magistrates\u2019 Court Disclosure Review and is being implemented as part of the Transforming Summary Justice (TSJ) programme.<\/p>\n<p>TSJ aims to create a more efficient and swifter criminal justice system.<\/p>\n<p>The new Streamlined Disclosure Certificate (SDC) follows revisions to the Crime and Procedure Act (CPIA) 1996 Code of Practice, which will change the procedure for the disclosure of unused material in summary cases.<\/p>\n<p>These revisions are now going through Parliament and are expected to be approved by the end of March.<\/p>\n<p>In the meantime, where there is agreement with the defence, the SDC for unused material may be used by police forces and CPS areas who have implemented TSJ.<\/p>\n<h3 id=\"timetable-for-roll-out\">Timetable for roll-out<\/h3>\n<p>The plan is to introduce the SDC in the remaining areas as the TSJ roll-out is completed between March and May 2015.<\/p>\n<p>In not guilty anticipated plea (NGAP) cases, the SDC will replace the current Manual of Guidance disclosure forms (the \u201cMG6C\/D\/E\u201d series.)
