{"id":56457,"date":"2015-04-21T08:59:37","date_gmt":"2015-04-21T08:59:37","guid":{"rendered":"http:\/\/mostafa.openonline.co.uk\/?guid=7a23db7f5b05615688e250902e464598"},"modified":"2015-04-21T08:59:37","modified_gmt":"2015-04-21T08:59:37","slug":"press-release-cma-receives-super-complaint-from-which","status":"publish","type":"post","link":"https:\/\/mostafa.openonline.co.uk\/?p=56457","title":{"rendered":"Press release: CMA receives super-complaint from Which?"},"content":{"rendered":"<div class=\"govspeak\">\n<p>Which? has identified 3 potential areas of concern that it would like the Competition and Markets Authority (<abbr title=\"Competition and Markets Authority\">CMA<\/abbr>) to investigate:<\/p>\n<ul>\n<li>confusing and misleading special offers<\/li>\n<li>a lack of easily comparable prices due to the way unit pricing is being done<\/li>\n<li>shrinking pack sizes without any corresponding price reduction<\/li>\n<\/ul>\n<p>Which? is also concerned about the impact of supermarket \u2018price match\u2019 schemes on consumer decision-making.<\/p>\n<p>The <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> will now consider the issues raised in the super-complaint in order to establish whether any element, or combination of elements, in the relevant market is or appears to be significantly harming the interests of consumers. It will publish a response to the super-complaint within 90 days.<\/p>\n<p>Possible outcomes include:<\/p>\n<ul>\n<li>recommending the quality and accessibility of information for consumers is improved<\/li>\n<li>encouraging businesses in the market to self-regulate<\/li>\n<li>making recommendations to government to change the legislation or public policy<\/li>\n<li>taking competition or consumer enforcement action<\/li>\n<li>instigating a market investigation or market study<\/li>\n<li>a clean bill of health<\/li>\n<\/ul>\n<p>The above list is not exhaustive and it should also be noted that a super-complaint could generate more than one outcome depending on the issues raised.<\/p>\n<p>The <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> will shortly invite interested parties to provide any evidence which may be useful to its assessment. More details will be available on the <a href=\"https:\/\/www.gov.uk\/cma-cases\/groceries-pricing-super-complaint\">case page<\/a><br \/>\n in due course.<\/p>\n<h3 id=\"notes-for-editors\">Notes for editors<\/h3>\n<ol>\n<li>The Enterprise Act 2002 (<abbr title=\"The Enterprise Act 2002\">the Act<\/abbr>) makes provision for designated consumer bodies to make super-complaints. A super-complaint, as defined by section 11(1) of <abbr title=\"The Enterprise Act 2002\">the Act<\/abbr>, is a complaint submitted by a designated consumer body that \u2018any feature, or combination of features, of a market in the United Kingdom for goods or services is or appears to be significantly harming the interests of consumers\u2019. Which? is a designated consumer body. Within 90 days after the day on which a super-complaint is received, the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> must say publicly how it proposes to deal with it.<\/li>\n<li>The <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> is the UK\u2019s primary competition and consumer authority. It is an independent non-ministerial government department with responsibility for carrying out investigations into mergers, markets and the regulated industries and enforcing competition and consumer law.
