{"id":56591,"date":"2015-04-29T13:59:00","date_gmt":"2015-04-29T13:59:00","guid":{"rendered":"http:\/\/mostafa.openonline.co.uk\/?guid=cf85af5977e6f3e887e929644cfa02b4"},"modified":"2015-04-29T13:59:00","modified_gmt":"2015-04-29T13:59:00","slug":"news-story-cat-dismisses-fipo-healthcare-appeal","status":"publish","type":"post","link":"https:\/\/mostafa.openonline.co.uk\/?p=56591","title":{"rendered":"News story: CAT dismisses FIPO healthcare appeal"},"content":{"rendered":"<div class=\"govspeak\">\n<p>The Federation of Independent Practitioner Organisations (<abbr title=\"Federation of Independent Practitioner Organisations\">FIPO<\/abbr>) had challenged the Competition and Markets Authority\u2019s (<abbr title=\"Competition and Markets Authority\">CMA<\/abbr>) finding in its <a href=\"https:\/\/www.gov.uk\/cma-cases\/private-healthcare-market-investigation#final-report\">final report<\/a> published in April 2014 that there was not an adverse effect on competition arising from the exercise of buyer power by private medical insurers and the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr>\u2019s remedy requiring more publicly available information on consultant fees.<\/p>\n<p>Today the Competition Appeal Tribunal (<abbr title=\"Competition Appeal Tribunal\">CAT<\/abbr>) <a rel=\"external\" href=\"http:\/\/www.catribunal.org.uk\/237-8520\/1230-6-12-14-Federation-of-Independent-Practitioner-Organisations.html\">dismissed the appeal<\/a> on all 7 grounds. <\/p>\n<p>The <abbr title=\"Competition Appeal Tribunal\">CAT<\/abbr> held its hearing on the <abbr title=\"Federation of Independent Practitioner Organisations\">FIPO<\/abbr> appeal in January 2015, when a separate challenge by AXA PPP on local anaesthetist groups was also heard. The <a href=\"https:\/\/www.gov.uk\/government\/news\/cat-dismisses-axa-ppp-appeal\">AXA PPP appeal was dismissed last month<\/a>. <\/p>\n<p>In December 2014, the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> appointed the <a rel=\"external\" href=\"http:\/\/www.phin.org.uk\/\">Private Healthcare Information Network<\/a> to provide independent information for private patients on healthcare performance and fees as required by the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr>\u2019s final report. Today\u2019s judgment means that the website will be able to carry information on consultants\u2019 fees along with information on their performance and the performance of private hospitals.  <\/p>\n<p>In December 2014, the <a href=\"https:\/\/www.gov.uk\/government\/news\/cat-ruling-on-private-healthcare-remittal\"><abbr title=\"Competition Appeal Tribunal\">CAT<\/abbr> agreed to the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr>\u2019s request<\/a> to quash part of its final report relating to the healthcare market in central London \u2013 and remit it back to the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> to reconsider and reach a new decision.
