{"id":60198,"date":"2015-08-10T14:02:55","date_gmt":"2015-08-10T14:02:55","guid":{"rendered":"http:\/\/mostafa.openonline.co.uk\/?guid=896dae0511c0954b122fb5960b44757c"},"modified":"2015-08-10T14:02:55","modified_gmt":"2015-08-10T14:02:55","slug":"news-story-cma-consults-on-muller-proposed-undertaking","status":"publish","type":"post","link":"https:\/\/mostafa.openonline.co.uk\/?p=60198","title":{"rendered":"News story: CMA consults on M\u00fcller proposed undertaking"},"content":{"rendered":"<div class=\"govspeak\">\n<p>In June 2015, the Competition and Markets Authority (<abbr title=\"Competition and Markets Authority\">CMA<\/abbr>) announced it would consider in detail undertakings proposed by Muller UK &amp; Ireland Group LLP (<abbr title=\"Muller UK &amp; Ireland Group LLP\">M\u00fcller<\/abbr>) instead of referring the case for an in-depth merger investigation. The proposed undertakings would require <abbr title=\"Muller UK &amp; Ireland Group LLP\">M\u00fcller<\/abbr> to sell to another dairy processor an option to require <abbr title=\"Muller UK &amp; Ireland Group LLP\">M\u00fcller<\/abbr> to process a certain volume of fresh milk each year for supply to national grocery retailers. <\/p>\n<p>The proposed undertakings are designed to replace any constraint that may have originated from the downsized Dairy Crest operations that the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> found may have existed absent the merger, as <a href=\"https:\/\/www.gov.uk\/government\/news\/dairy-merger-faces-in-depth-investigation-unless-undertakings-offered\">set out in its decision<\/a> of 12 June 2015.<\/p>\n<p><abbr title=\"Muller UK &amp; Ireland Group LLP\">M\u00fcller<\/abbr> has proposed 2 potential dairy processors with whom it is in negotiations to enter into the toll processing agreement: Medina Holdings Limited and Nijjar Group Holdings (Acton) Limited (trading as Freshways). The <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> proposes to accept the proposed undertaking, which it currently considers is appropriate to remedy its competition concerns.<\/p>\n<p>Before reaching a final decision on whether to accept the proposed undertakings, the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> is inviting third party views to comment on both the suitability of these 2 potential purchasers as effective competitors to <abbr title=\"Muller UK &amp; Ireland Group LLP\">M\u00fcller<\/abbr> in the supply of fresh milk to national multiples in the Severnside catchment area, and on whether the proposed undertakings are appropriate to remedy in a clear cut manner the competition concerns identified by the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> in its decision dated 12 June 2015.<\/p>\n<p>The deadline for responses is 25 August 2015.<\/p>\n<p>The <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> has also today announced that it is extending the deadline for consideration of the proposed undertakings by up to 40 working days until 19 October.
