{"id":60926,"date":"2015-09-02T14:36:48","date_gmt":"2015-09-02T14:36:48","guid":{"rendered":"http:\/\/mostafa.openonline.co.uk\/?guid=2084c4305e5823d8072abcebceaf5a94"},"modified":"2015-09-02T14:36:48","modified_gmt":"2015-09-02T14:36:48","slug":"news-story-crime-news-fastrak-court-costs-claims-scheme-to-be-mandatory","status":"publish","type":"post","link":"https:\/\/mostafa.openonline.co.uk\/?p=60926","title":{"rendered":"News story: Crime news: \u2018Fastrak\u2019 court costs claims scheme to be mandatory"},"content":{"rendered":"<div class=\"govspeak\">\n<p>The \u2018Fastrak\u2019 scheme for claiming costs out of central funds for criminal court work is to be made mandatory from 1 October 2015.<\/p>\n<p>Claims which qualify for the \u2018Fastrak\u2019 scheme operated by the National Taxing Team (NTT) should already be made using this process whenever possible.<\/p>\n<p>But it is important to note that any qualifying claim received on or after 1 October 2015 which does not use \u2018Fastrak\u2019 will be returned.<\/p>\n<p>Claim forms covered by the NTT \u2018Fastrak\u2019 scheme are available to download on GOV.UK. These include:<\/p>\n<ul>\n<li>Defence Costs Order (DCO) claims<\/li>\n<\/ul>\n<p>This is for magistrates\u2019 court cases only where the claim is for profit costs of \u00a32,000 or less. It should not be used for costs of a court appointee.<\/p>\n<p>You need to download and submit form 5911 i.e. \u2018application for costs from central funds\u2019 \u2013 see link below.<\/p>\n<p>It is important to complete the checklist of documents at the end of the form. Rates to be claimed are post Legal Aid, Sentencing and Punishment of Offenders Act 2012.<\/p>\n<ul>\n<li>Litigators Proceeds of Crime Act claims<\/li>\n<\/ul>\n<p>This is where the amount claimed is for profit costs of \u00a32,000 or less. You need to download and submit claim form 5144 i.e. \u2018solicitor\u2019s claim for costs legal aid in criminal and care proceedings (costs) regulations 1989\u2019 \u2013 see link below.<\/p>\n<p>The \u2018litigator claim (confiscation proceedings) required declaration\u2019 must also be completed. This is otherwise known as the Proceeds of Crime Act (POCA) declaration sheet. <\/p>\n<h3 id=\"importance-of-fastrak-declaration\">Importance of \u2018Fastrak\u2019 declaration<\/h3>\n<p>You must remember to enclose the relevant \u2018Fastrak\u2019 checklist\/declaration and this should be presented as the top document when submitting your claim.<\/p>\n<p>All documents listed in the checklist\/declaration must be included. If any are missing your claim will be returned.<\/p>\n<h3 id=\"timescale\">Timescale<\/h3>\n<p>We aim to process \u2018Fastrak\u2019 claims within a month of receipt.<\/p>\n<h3 id=\"do-not-send-your-file\">Do not send your file<\/h3>\n<p>You should not send your file.
