{"id":61987,"date":"2015-09-23T10:00:18","date_gmt":"2015-09-23T10:00:18","guid":{"rendered":"http:\/\/mostafa.openonline.co.uk\/?guid=7762bb4bba95b2c6adc3c3d212491409"},"modified":"2015-09-23T10:00:18","modified_gmt":"2015-09-23T10:00:18","slug":"press-release-cma-continues-remedies-pruning","status":"publish","type":"post","link":"https:\/\/mostafa.openonline.co.uk\/?p=61987","title":{"rendered":"Press release: CMA continues remedies pruning"},"content":{"rendered":"<div class=\"govspeak\">\n<p>It is consulting on provisional advice to the Secretary of State for Business, Innovation and Skills that the remaining obligations in 7 structural merger remedies imposed under the Fair Trading Act 1973 (<abbr title=\"Fair Trading Act 1973\">FTA<\/abbr>) should be removed. It has also determined that 11 further <abbr title=\"Fair Trading Act 1973\">FTA<\/abbr> merger remedies have now lapsed. This is the first output of the ongoing <a href=\"https:\/\/www.gov.uk\/government\/news\/cma-to-review-structural-merger-undertakings\">review of 76 structural merger undertakings<\/a> given by companies prior to 1 January 2005. <\/p>\n<p>The <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> is also consulting on provisional decisions to remove 2 sets of monopoly remedies, specifically the <a href=\"https:\/\/www.gov.uk\/cma-cases\/credit-cards-merchant-acquisition-order-1990-review\">Credit Cards (Merchant Acquisition) Order 1990<\/a> and <a href=\"https:\/\/www.gov.uk\/cma-cases\/tin-cans-metal-box-undertakings-review\">undertakings given by Metal Box plc in 1972<\/a> (see notes for editors). <\/p>\n<p>These provisional decisions \u2013 made by a group of 3 panel members, chaired by Simon Polito \u2013 form part of a programme of work, set out in the <a href=\"https:\/\/www.gov.uk\/government\/publications\/competition-and-markets-authority-annual-plan-2015-to-2016\"><abbr title=\"Competition and Markets Authority\">CMA<\/abbr>\u2019s annual plan 2015 to 2016<\/a> and likely to continue in subsequent years, which aims to reduce burdens on business by assessing whether past merger and market remedies have become unnecessary. As part of this programme, the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> is also <a href=\"https:\/\/www.gov.uk\/government\/consultations\/review-of-monopoly-remedies-put-in-place-before-1-january-2005\">currently considering<\/a> whether to carry out further reviews of 13 sets of monopoly remedies put in place by the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr>\u2019s predecessors prior to 2005, and which have not been reviewed recently. <\/p>\n<p>In addition, the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> has today published <a href=\"https:\/\/www.gov.uk\/government\/publications\/market-studies-and-market-investigations-supplemental-guidance-on-the-cmas-approach\">updated guidance<\/a> on the use of \u2018sunset clauses\u2019 in market investigations, <a href=\"https:\/\/www.gov.uk\/government\/news\/cma-consults-on-updated-guidance-for-sunset-clauses\">following a consultation<\/a>. Sunset clauses act as a time limit on new remedies created by the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> by specifying a date or event after which they will no longer apply. Although the previous published guidance on market investigations made reference to sunset clauses, the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> is now making a clearer commitment to considering the use of such time-limited remedies in future investigations, as well as providing guidance on how it will do so. The updated guidance also sets out the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr>\u2019s approach to reviewing the continuing appropriateness of remedies in market investigations without sunset clauses, or where the sunset clause substantially exceeds 10 years.<\/p>\n<p>Adam Land, the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr>\u2019s Senior Director of Remedies, Business and Financial Analysis, said:<\/p>\n<blockquote>\n<p>These provisional decisions are an important first step in our ambitious programme of work to review old remedies, getting rid of any that are no longer needed and fine-tuning those that need adjustment. It is an independent non-ministerial government department with responsibility for carrying out investigations into mergers, markets and the regulated industries and enforcing competition and consumer law. \t\t\t\t\t\t\t\t\t<\/li>\n<li>The <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> has a statutory duty under the Fair Trading Act 1973 and the Enterprise Act 2002 to keep under review undertakings and orders. From time to time, the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> must consider whether, by reason of any change of circumstances: undertakings are no longer appropriate and need to be varied, superseded or released; or an order is no longer appropriate and needs to be varied or revoked.
