{"id":63926,"date":"2015-11-10T11:47:30","date_gmt":"2015-11-10T11:47:30","guid":{"rendered":"http:\/\/mostafa.openonline.co.uk\/?guid=500c178d8750513be30ed75b98c267fa"},"modified":"2015-11-10T11:47:30","modified_gmt":"2015-11-10T11:47:30","slug":"press-release-competition-problems-provisionally-found-in-private-healthcare","status":"publish","type":"post","link":"https:\/\/mostafa.openonline.co.uk\/?p=63926","title":{"rendered":"Press release: Competition problems provisionally found in private healthcare"},"content":{"rendered":"<div class=\"govspeak\">\n<p>In April 2012, the Competition Commission, a predecessor body of the Competition and Markets Authority (<abbr title=\"Competition and Markets Authority\">CMA<\/abbr>), started a market investigation into private healthcare which reported in April 2014, immediately after the establishment of the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr>. The report concluded that certain features of the markets for privately-funded healthcare services were leading to an adverse effect on competition (<abbr title=\"adverse effect on competition\">AEC<\/abbr>). The <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> required HCA International Limited, the largest private hospital operator in central London, to sell one or two of its hospitals. <\/p>\n<p>HCA appealed to the Competition Appeal Tribunal (<abbr title=\"Competition Appeal Tribunal\">CAT<\/abbr>), which in January 2015 set aside part of the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr>\u2019s findings and <a href=\"https:\/\/www.gov.uk\/government\/news\/cat-ruling-on-private-healthcare-remittal\">sent the case back to the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr><\/a> to reconsider.<\/p>\n<p>In its <a href=\"https:\/\/www.gov.uk\/cma-cases\/private-healthcare-market-investigation\">provisional findings report<\/a> published today, the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> has provisionally found that HCA\u2019s large market share, combined with high barriers to entry and expansion in central London, result in HCA facing weak competitive constraints and this leads to HCA charging higher prices to private medical insurers than would be expected in a well-functioning market. This is in addition to the <abbr title=\"adverse effect on competition\">AEC<\/abbr> for patients who self-pay in central London, which the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> identified in its original report and which was not quashed by the <abbr title=\"Competition Appeal Tribunal\">CAT<\/abbr>.<\/p>\n<p>The <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> is consulting on possible remedies to address the concerns it has identified. The remedies which the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> is currently minded to consider are:<\/p>\n<ul>\n<li>the divestment of one or more hospital(s) by HCA<\/li>\n<li>HCA allowing competitors access to one or more of its hospital(s)<\/li>\n<li>preventing further expansion by HCA in central London<\/li>\n<\/ul>\n<p>The <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> will consult on its provisional findings and potential remedies before publishing a final report in March 2016.<\/p>\n<p>Roger Witcomb, Chairman of the Private Healthcare Market Remittal Group, said:<\/p>\n<blockquote>\n<p>Following a long and thorough re-examination of the issues remitted back to us by the Competition Appeal Tribunal we have provisionally concluded that there is still a competition problem that needs addressing.<\/p>\n<p class=\"last-child\">We will now consult widely and listen carefully to all responses to our provisional findings and potential remedies before we publish our final report.<\/p>\n<\/blockquote>\n<p>The remittal was made after HCA identified errors in the insured pricing analysis during its appeal. As part of the remittal, the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> revised this analysis and consulted on it through the publication of a working paper on 11 June 2015.<\/p>\n<p>As well as revising its insured pricing analysis, the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> also took into account all relevant arguments and evidence put to it by parties in relation to the other analysis that supported its original findings. <\/p>\n<p>The <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> has already brought in a number of changes in the private healthcare market as a result of the initial investigation including:<\/p>\n<ul>\n<li>The appointment of the <a href=\"https:\/\/www.gov.uk\/government\/news\/better-information-for-private-patients-moves-closer\">Private Healthcare Information Network<\/a> to provide independent information for private patients on healthcare performance and fees as required by the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr>\u2019s final report. The website will carry information on consultants\u2019 fees along with information on their performance and the performance of private hospitals.<\/li>\n<li>\n<a href=\"https:\/\/www.gov.uk\/government\/news\/cma-finalises-private-healthcare-changes\">A crackdown on benefits and incentive schemes<\/a> provided to referring clinicians by private hospital operators.\t\t\t\t\t\t\t\t\t<\/li>\n<li>The ability for the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> to be able to review future arrangements where private hospital operators team up with NHS private patient units (<abbr title=\"private patient units\">PPUs<\/abbr>) and ban any that might substantially lessen competition.<\/li>\n<\/ul>\n<h3 id=\"notes-for-editors\">Notes for editors<\/h3>\n<ol>\n<li>The <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> is the UK\u2019s primary competition and consumer authority.
