{"id":64993,"date":"2015-12-04T11:15:52","date_gmt":"2015-12-04T11:15:52","guid":{"rendered":"http:\/\/mostafa.openonline.co.uk\/?guid=dca995624fef00b26c4c17b656e8cb68"},"modified":"2015-12-04T11:15:52","modified_gmt":"2015-12-04T11:15:52","slug":"news-story-cma-uses-new-power-to-highlight-competition-issues-on-energy-bill","status":"publish","type":"post","link":"https:\/\/mostafa.openonline.co.uk\/?p=64993","title":{"rendered":"News story: CMA uses new power to highlight competition issues on Energy Bill"},"content":{"rendered":"<div class=\"govspeak\">\n<p>This is the first use by the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> of its new power to <a href=\"https:\/\/www.gov.uk\/government\/news\/cma-gains-power-to-make-written-recommendations-on-proposals-for-legislation\">make and publish written recommendations<\/a> to ministers on the impact of proposals for Westminster legislation on competition.<\/p>\n<p><abbr title=\"Competition and Markets Authority\">CMA<\/abbr> Chief Executive Alex Chisholm <a href=\"https:\/\/www.gov.uk\/government\/publications\/energy-bill-cma-recommendations-to-ministers\">has written to Energy and Climate Change Secretary Amber Rudd<\/a> commenting on the provisions of the Energy Bill currently before Parliament and recommending that she ensure that the new Oil and Gas Authority (<abbr title=\"Oil and Gas Authority\">OGA<\/abbr>) takes account of any risks to competition created by the provisions of the Bill and of the impact of its actions on competition in markets.<\/p>\n<p>The <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> has highlighted potential competition risks; for example that the work of the <abbr title=\"Oil and Gas Authority\">OGA<\/abbr> helps to create an environment where companies might form anti-competitive agreements or exchange sensitive information on future pricing intentions.<\/p>\n<p>The <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> has also been in contact with the <abbr title=\"Oil and Gas Authority\">OGA<\/abbr> to help ensure that, when it is working with industry participants, neither breach competition law nor are deterred from legitimate and beneficial collaboration by fear of breaching the law.<\/p>\n<p>The <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> considers it important that the <abbr title=\"Oil and Gas Authority\">OGA<\/abbr>:<\/p>\n<ul>\n<li>acts at all times in accordance with competition law<\/li>\n<li>does not act in ways that might, even inadvertently, encourage or facilitate breaches of competition law by others<\/li>\n<li>promotes and supports competition in industries it regulates<\/li>\n<li>where possible, uses pro-competitive mechanisms to advance its aims<\/li>\n<\/ul>\n<p>This power was granted to the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> by the Small Business, Enterprise and Employment Act 2015.<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>The CMA has asked the government to ensure that the benefits of competition are properly considered by the new Oil and Gas Authority.<\/p>\n","protected":false},"author":8,"featured_media":0,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[13],"tags":[],"_links":{"self":[{"href":"https:\/\/mostafa.openonline.co.uk\/index.php?rest_route=\/wp\/v2\/posts\/64993"}],"collection":[{"href":"https:\/\/mostafa.openonline.co.uk\/index.php?rest_route=\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/mostafa.openonline.co.uk\/index.php?rest_route=\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/mostafa.openonline.co.uk\/index.php?rest_route=\/wp\/v2\/users\/8"}],"replies":[{"embeddable":true,"href":"https:\/\/mostafa.openonline.co.uk\/index.php?rest_route=%2Fwp%2Fv2%2Fcomments&post=64993"}],"version-history":[{"count":0,"href":"https:\/\/mostafa.openonline.co.uk\/index.php?rest_route=\/wp\/v2\/posts\/64993\/revisions"}],"wp:attachment":[{"href":"https:\/\/mostafa.openonline.co.uk\/index.php?rest_route=%2Fwp%2Fv2%2Fmedia&parent=64993"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/mostafa.openonline.co.uk\/index.php?rest_route=%2Fwp%2Fv2%2Fcategories&post=64993"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/mostafa.openonline.co.uk\/index.php?rest_route=%2Fwp%2Fv2%2Ftags&post=64993"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
