{"id":66066,"date":"2016-01-04T16:00:00","date_gmt":"2016-01-04T16:00:00","guid":{"rendered":"http:\/\/mostafa.openonline.co.uk\/?guid=261059a645593f54a775d783e607caf1"},"modified":"2016-01-04T16:00:00","modified_gmt":"2016-01-04T16:00:00","slug":"news-story-cma-refers-cleanroom-laundry-merger-for-in-depth-investigation","status":"publish","type":"post","link":"https:\/\/mostafa.openonline.co.uk\/?p=66066","title":{"rendered":"News story: CMA refers cleanroom laundry merger for in-depth investigation"},"content":{"rendered":"<div class=\"govspeak\">\n<p><a href=\"https:\/\/www.gov.uk\/government\/news\/cleanroom-laundry-service-merger-could-face-in-depth-investigation\">Last month<\/a>, the Competition and Markets Authority (<abbr title=\"Competition and Markets Authority\">CMA<\/abbr>) said that it would refer this merger for an in-depth investigation unless <abbr title=\"Fenland Laundries Limited\">Fenland<\/abbr> Laundries Limited (<abbr title=\"Fenland Laundries Limited\">Fenland<\/abbr>) offered acceptable undertakings to address the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr>\u2019s competition concerns. The concerns relate to the supply of laundry services to the higher cleanroom laundry standard (full cleanroom) in Great Britain.<\/p>\n<p><abbr title=\"Fenland Laundries Limited\">Fenland<\/abbr> offered undertakings on 23 December 2015 to address the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr>\u2019s competition concerns in lieu of a reference. After careful consideration, the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> was not confident that these would resolve the concerns in a clear-cut manner (see note) and has therefore decided to refer the merger for an in-depth phase 2 investigation.<\/p>\n<p>A decision on the merger at phase 2 will be made by a group of independent panel members supported by a case team of <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> staff. The deadline for the final report will be 19 June 2016.<\/p>\n<p>Details of the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr>\u2019s decision will be available on the <a href=\"https:\/\/www.gov.uk\/cma-cases\/fenland-fishers-services-cleanroom-laundry-business-merger-inquiry\">case page<\/a> shortly.<\/p>\n<h3 id=\"note\">Note<\/h3>\n<p>Section 73(3) of the Enterprise Act 2002 states: <\/p>\n<blockquote>\n<p class=\"last-child\">\u2026the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> shall, in particular, have regard to the need to achieve as comprehensive a solution as is reasonable and practicable to the substantial lessening of competition and any adverse effects resulting from it.<\/p>\n<\/blockquote>\n<p>In the <a href=\"https:\/\/www.gov.uk\/government\/publications\/mergers-guidance-on-the-cmas-jurisdiction-and-procedure\">Mergers: Guidance on the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr>\u2019s jurisdiction and procedure<\/a>, paragraph 8.3 states that: <\/p>\n<blockquote>\n<p class=\"last-child\">the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> must be confident that the competition concerns identified will be resolved by means of the UILs (undertakings in lieu) offered without the need for further investigation.
