It licenses musical works and administers the royalties when such works are played in public or broadcast, for example on the radio or television.<\/p>\n<p>The Competition and Markets Authority (<abbr title=\"Competition and Markets Authority\">CMA<\/abbr>) announced in November 2015 that it would carry out a <a href=\"https:\/\/www.gov.uk\/government\/news\/cma-reviews-performing-right-society-undertakings\">review of the undertakings<\/a> which followed a 1996 <a rel=\"external\" href=\"http:\/\/webarchive.nationalarchives.gov.uk\/20111202195250\/http:\/competition-commission.org.uk\/rep_pub\/reports\/1996\/378performing.htm#summary\">Monopolies and Mergers Commission (<abbr title=\"Monopolies and Mergers Commission\">MMC<\/abbr>) investigation<\/a>. In 1997 the <abbr title=\"Performing Right Society\">PRS<\/abbr> gave undertakings allowing its members to administer their own live performing rights, as well as making other commitments over its corporate governance and the provision of information to the Office of Fair Trading (now the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr>).<\/p>\n<p>The current review has been considering whether there has been a change of circumstance such that the undertakings are no longer appropriate and should be varied, released or retained. The review has not been examining wider issues relating to the <abbr title=\"Performing Right Society\">PRS<\/abbr> or performing rights in general.<\/p>\n<p>The group of independent <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> panel members carrying out the review considers that the forthcoming implementation of the <abbr title=\"European Union\">EU<\/abbr> Collective Rights Management Directive will effectively address the areas and concerns covered by the undertakings. The group has therefore provisionally decided that the undertakings are no longer required.<\/p>\n<p>This Directive, due to be implemented by each <abbr title=\"European Union\">EU<\/abbr> Member State by 10 April 2016,  introduces a number of requirements that collective management organisations, such as the <abbr title=\"Performing Right Society\">PRS<\/abbr>, must meet \u2013 as well as various protections for their members. The requirements are intended to \u2018ensure a high standard of governance, financial management, transparency and reporting.\u2019<\/p>\n<p>The provisional decision and other information relating to the review can be found on the <abbr title=\"Performing Right Society\">PRS<\/abbr> <a href=\"https:\/\/www.gov.uk\/cma-cases\/performing-right-society-undertakings-review\">case page<\/a>. These decisions and full details of the whole project can be found on the <a href=\"https:\/\/www.gov.uk\/cma-cases\/review-of-structural-merger-undertakings-given-before-1-january-2005\">remedies review page<\/a>.<\/p>\n<h4 id=\"notes-for-editors\">Notes for editors<\/h4>\n<ol>\n<li>The <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> is the UK\u2019s primary competition and consumer authority. It is an independent non-ministerial government department with responsibility for carrying out investigations into mergers, markets and the regulated industries and enforcing competition and consumer law. From 1 April 2014 it took over the functions of the Competition Commission (<abbr title=\"Competition Commission\">CC<\/abbr>) and the competition and certain consumer functions of the Office of Fair Trading, as amended by the Enterprise and Regulatory Reform Act 2013. The <abbr title=\"Monopolies and Mergers Commission\">MMC<\/abbr> was the <abbr title=\"Competition Commission\">CC<\/abbr>\u2019s predecessor organisation.<\/li>\n<li>The <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> has a statutory duty under the Fair Trading Act 1973 and the Enterprise Act 2002 to keep under review undertakings and orders. From time to time, the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> must consider whether, by reason of any change of circumstances: undertakings are no longer appropriate and need to be varied, superseded or released; or an order is no longer appropriate and needs to be varied or revoked.<\/li>\n<li>The <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> group reviewing the <abbr title=\"Performing Right Society\">PRS<\/abbr> undertakings consists of <a href=\"https:\/\/www.gov.uk\/government\/publications\/cma-panel-member-biographies-and-disclosures-of-interest\/inquiry-chairs-biographies#simon-polito\">Simon Polito<\/a> (Chair), <a href=\"https:\/\/www.gov.uk\/government\/publications\/cma-panel-member-biographies-and-disclosures-of-interest\/inquiry-chairs-biographies#anne-lambert\">Anne Lambert<\/a> and <a href=\"https:\/\/www.gov.uk\/government\/publications\/cma-panel-member-biographies-and-disclosures-of-interest\/inquiry-chairs-biographies#professor-philip-marsden\">Philip Marsden<\/a>. <\/li>\n<li>The <a href=\"https:\/\/www.gov.uk\/cma-cases\/review-of-structural-merger-undertakings-given-before-1-january-2005#decision-to-undertake-review\">list of cases<\/a> published on 26 March 2015 contained 76 structural merger undertakings.
