{"id":69315,"date":"2016-04-06T08:00:03","date_gmt":"2016-04-06T08:00:03","guid":{"rendered":"http:\/\/mostafa.openonline.co.uk\/?guid=c90ebf10b721d7330d8a92caec368e7c"},"modified":"2016-04-06T08:00:03","modified_gmt":"2016-04-06T08:00:03","slug":"news-story-changes-to-the-bankruptcy-application-process-what-you-need-to-know","status":"publish","type":"post","link":"https:\/\/mostafa.openonline.co.uk\/?p=69315","title":{"rendered":"News story: Changes to the bankruptcy application process: what you need to know"},"content":{"rendered":"<div class=\"govspeak\">\n<p>If you are in the process of or are thinking about applying for bankruptcy, the headings below provide an overview of these changes and how they might affect you. <\/p>\n<h3 id=\"how-the-process-has-changed\">How the process has changed<\/h3>\n<p>Previously all bankruptcy applications had to be submitted to the court and looked at by a judge. <\/p>\n<p>On 06 April 2016, the application process for people wishing to make themselves bankrupt moved online and out of the courts. <\/p>\n<p>This means that you now have to fill in your bankruptcy application online rather than using a paper form and you no longer have to go to court. Instead, you submit your completed application electronically to an adjudicator who makes a decision about your application<\/p>\n<p>The process for <a href=\"https:\/\/www.gov.uk\/apply-to-bankrupt-someone\">making someone else bankrupt<\/a> remains unchanged.<\/p>\n<p>You can find out more about the new process on the GOV.UK <a href=\"https:\/\/www.gov.uk\/bankruptcy\">Apply for bankruptcy pages<\/a>.<\/p>\n<h3 id=\"about-the-adjudicator\">About the adjudicator<\/h3>\n<p>The adjudicator isn\u2019t a judge. They are a government official who work for the <a href=\"https:\/\/www.gov.uk\/government\/organisations\/insolvency-service\">Insolvency Service<\/a>, and their role is to review and make decisions about individuals\u2019 bankruptcy applications. <\/p>\n<h3 id=\"changes-to-the-fee\">Changes to the fee<\/h3>\n<p>On 06 April 2016 the fee changed from \u00a3705 to \u00a3655: <\/p>\n<ul>\n<li>\u00a3130 for considering your application <\/li>\n<li>\u00a3525 for managing your bankruptcy<\/li>\n<\/ul>\n<p>For the first time you can now also pay your fee online and in instalments.<\/p>\n<h3 id=\"starting-an-online-bankruptcy-application\">Starting an online bankruptcy application<\/h3>\n<p>To start an online application, visit <a rel=\"external\" href=\"https:\/\/apply-for-bankruptcy.service.gov.uk\">https:\/\/apply-for-bankruptcy.service.gov.uk<\/a><\/p>\n<h3 id=\"help-using-the-online-form\">Help using the online form<\/h3>\n<p>The only way to apply for bankruptcy in England and Wales from 06 April is using the online form. <\/p>\n<p>If you don\u2019t have access to a computer or don\u2019t feel comfortable using one, you can get help from friends and family. You can also get <a rel=\"external\" href=\"http:\/\/www.moneyadviceservice.org.uk\/en\/tools\/debt-advice-locator\">free help and advice from a debt adviser<\/a> or from <a href=\"https:\/\/www.gov.uk\/the-insolvency-service\">the Insolvency Service Enquiry Line<\/a>. <\/p>\n<h3 id=\"paper-applications-started-before-05-april-2016\">Paper applications started before 05 April 2016<\/h3>\n<p>If you\u2019ve started a paper bankruptcy application and haven\u2019t already submitted it to the court you will have to start again using the new online application.<\/p>\n<p>If you submitted your paperwork and fee to the court before 06 April, the court will continue dealing with your bankruptcy application.
