{"id":69875,"date":"2016-04-22T14:00:49","date_gmt":"2016-04-22T14:00:49","guid":{"rendered":"http:\/\/mostafa.openonline.co.uk\/?guid=116bcef8d9076e63f014bd78fa779a28"},"modified":"2016-04-22T14:00:49","modified_gmt":"2016-04-22T14:00:49","slug":"press-release-cma-continues-its-mission-to-remove-unnecessary-remedies","status":"publish","type":"post","link":"https:\/\/mostafa.openonline.co.uk\/?p=69875","title":{"rendered":"Press release: CMA continues its mission to remove unnecessary remedies"},"content":{"rendered":"<div class=\"govspeak\">\n<p>In March, the Competition and Markets Authority (<abbr title=\"Competition and Markets Authority\">CMA<\/abbr>) <a href=\"https:\/\/www.gov.uk\/government\/news\/cma-publishes-latest-remedy-review-decisions\">completed its review<\/a> of 71 old structural merger remedies given by companies prior to 1 January 2005. As a result, 51 of these remedies were removed by the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr>.<\/p>\n<p>The <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> has also completed 2 larger reviews of behavioural remedies this week, with its final decision to <a href=\"https:\/\/www.gov.uk\/government\/news\/cma-releases-firstgroup-plc-bus-undertakings\">remove FirstGroup plc bus undertakings<\/a> on 20 April, and earlier today, the final decision to <a href=\"https:\/\/www.gov.uk\/government\/news\/cma-to-vary-rough-undertakings\">vary the undertakings given by Centrica<\/a>, following the Rough gas storage review.<\/p>\n<p>Ahead of its next reviews, which will start in the summer, the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> has identified a further 38, mostly behavioural merger remedies that are more than 10 years old. It is now <a href=\"https:\/\/www.gov.uk\/government\/consultations\/review-of-merger-undertakings-given-before-1-january-2006\">inviting comments<\/a> on which of these it should prioritise in the forthcoming reviews.<\/p>\n<p>This exercise forms part of a wider programme of work on remedy reviews, initially set out in the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr>\u2019s <a href=\"https:\/\/www.gov.uk\/government\/news\/cma-lays-out-plans-for-coming-year\">2015\/16 annual plan<\/a>, with the aim of reducing burdens on business by assessing whether past merger and market remedies should be removed. The <a href=\"https:\/\/www.gov.uk\/government\/news\/cma-sets-out-priorities-for-201617\">2016\/17 annual plan<\/a> restates this aim and pledges to build on the work carried out during the last year.<\/p>\n<p>Adam Land, the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr>\u2019s Senior Director of Remedies, Business and Financial Analysis, said:<\/p>\n<blockquote>\n<p class=\"last-child\">We\u2019ve done some valuable work clearing out unnecessary remedies over the past year. This work reduces ongoing burdens on business and enables the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> to focus its resources on enforcing those remedies that still matter. We\u2019re looking to continue that momentum and have identified another batch of older remedies that look like suitable candidates for review. It is an independent non-ministerial government department with responsibility for carrying out investigations into mergers, markets and the regulated industries and enforcing competition and consumer law. <\/li>\n<li>The <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> has a statutory duty under the Fair Trading Act 1973 and the Enterprise Act 2002 to keep undertakings and orders under review. From time to time, the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> must consider whether, by reason of any change of circumstances: undertakings are no longer appropriate and need to be varied, superseded or released; or an order is no longer appropriate and needs to be varied or revoked.
