{"id":70036,"date":"2016-04-28T13:01:40","date_gmt":"2016-04-28T13:01:40","guid":{"rendered":"http:\/\/mostafa.openonline.co.uk\/?guid=d2567f3df3435b56f058ec6a2eb32134"},"modified":"2016-04-28T13:01:40","modified_gmt":"2016-04-28T13:01:40","slug":"press-release-barclays-breach-leads-to-apology-and-refund-for-ppi-customers","status":"publish","type":"post","link":"https:\/\/mostafa.openonline.co.uk\/?p=70036","title":{"rendered":"Press release: Barclays breach leads to apology and refund for PPI customers"},"content":{"rendered":"<div class=\"govspeak\">\n<p>The apology letters, sent out to all affected customers, explained the error and offered to refund payment protection insurance (<abbr title=\"payment protection insurance\">PPI<\/abbr>) premiums paid out since the date of the first missing statement \u2013 as well as 8% interest \u2013 to those who cancel their policy as a result.<\/p>\n<p>One of the measures introduced in the 2011 order that followed the <a rel=\"external\" href=\"https:\/\/assets.digital.cabinet-office.gov.uk\/media\/5519489140f0b6140100015b\/13_11_ppi_cc_publishes_final_order.pdf\">Competition Commission\u2019s (<abbr title=\"Competition Commission\">CC<\/abbr>) investigation into <abbr title=\"payment protection insurance\">PPI<\/abbr><\/a> was that all customers would receive an annual statement from their provider setting out the cost of <abbr title=\"payment protection insurance\">PPI<\/abbr> and including a reminder of their right to cancel.<\/p>\n<p>A compliance report by Barclays in April 2015 revealed that 52 <abbr title=\"payment protection insurance\">PPI<\/abbr> credit card customers had not received their annual statement.<\/p>\n<p>Further investigation into the issue revealed that, over the last 3 annual statement periods, a total of 9,404 credit card <abbr title=\"payment protection insurance\">PPI<\/abbr> customers had not received their statements. Additionally 740 customers on a specific mortgage <abbr title=\"payment protection insurance\">PPI<\/abbr> scheme had not received annual statements since the <abbr title=\"Competition Commission\">CC<\/abbr> order came into force in 2012.<\/p>\n<p>The <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> has sent a <a href=\"https:\/\/www.gov.uk\/government\/publications\/letter-from-the-cma-to-barclays-on-ppi-annual-review-statements\">letter<\/a> to Barclays about this breach of the order, requiring it to provide additional reporting on its controls to ensure that all such customers receive their statements in future.<\/p>\n<p>Adam Land, the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr>\u2019s Senior Director of Remedies, Business and Financial Analysis, said:<\/p>\n<blockquote>\n<p>The annual statement was an important measure resulting from the market investigation which ensures customers know they have a <abbr title=\"payment protection insurance\">PPI<\/abbr> policy, how much they are spending on it and reminds them of their right to cancel or switch.<\/p>\n<p class=\"last-child\">Barclays has now taken the necessary steps to alert and recompense affected customers &#8211; as well as to ensure that there is no repeat in future. We trust that the extra reporting requirements we\u2019ve put in place will confirm this.<\/p>\n<\/blockquote>\n<h3 id=\"notes-for-editors\">Notes for editors<\/h3>\n<ol>\n<li>The <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> is the UK\u2019s primary competition and consumer authority. It is an independent non-ministerial government department with responsibility for carrying out investigations into mergers, markets and the regulated industries and enforcing competition and consumer law.<\/li>\n<li>When the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> came into being in April 2014, it assumed the responsibility for monitoring and enforcing orders and undertakings introduced by its predecessor organisations, the <abbr title=\"Competition Commission\">CC<\/abbr> and the Office of Fair Trading.<\/li>\n<li>The <a href=\"https:\/\/www.gov.uk\/government\/publications\/ppi-market-investigation-order-2011\">Payment Protection Market Investigation Order 2011<\/a>.<\/li>\n<li>The <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> has duties relating to the monitoring of an enforcement order and rights to enforce an order under sections 162 and 167 respectively of the Enterprise Act 2002. Where a party does not comply with an enforcement order, the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> may apply to the court to seek an appropriate remedy. The <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> does not have a power to impose financial penalties for non-compliance. The Act also gives rights to persons who sustain loss or damage to enforce the order directly.
