{"id":71035,"date":"2016-05-27T06:00:13","date_gmt":"2016-05-27T06:00:13","guid":{"rendered":"http:\/\/mostafa.openonline.co.uk\/?guid=d80f0dee093df2d566e759de211d9367"},"modified":"2016-05-27T06:00:13","modified_gmt":"2016-05-27T06:00:13","slug":"press-release-cloud-storage-companies-promise-fairer-deal-for-consumers","status":"publish","type":"post","link":"https:\/\/mostafa.openonline.co.uk\/?p=71035","title":{"rendered":"Press release: Cloud storage companies promise fairer deal for consumers"},"content":{"rendered":"<div class=\"govspeak\">\n<p>Following the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr>\u2019s consumer law review of the sector, <a href=\"https:\/\/www.gov.uk\/government\/consultations\/cloud-storage-consumer-law-compliance-review\">published today<\/a>, Dixons Carphone plc, JustCloud and Livedrive have <a href=\"https:\/\/www.gov.uk\/cma-cases\/cloud-storage-consumer-compliance-review\">committed<\/a> to provide fairer terms for their cloud storage customers. The <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> is continuing to work with a number of other companies to make their terms and practices fairer.<\/p>\n<p>Cloud storage is a system for storing data such as music, films and photographs on remote servers. The <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> found that around 3 in 10 British adults use cloud storage in a personal capacity. The majority currently benefit from free services that come with their devices such as smartphones and tablets and consumers are generally satisfied with their services.<\/p>\n<p>However, it also heard some concerns and found that businesses have some contract terms and practices which could be in breach of consumer law, including those giving companies the ability to:<\/p>\n<ul>\n<li>change the service or terms of the contract at any time, for any reason and without notice<\/li>\n<li>suspend or terminate the contract without notice for any reason<\/li>\n<li>automatically renew a contract at the end of a fixed term without giving notice or withdrawal rights<\/li>\n<\/ul>\n<p>The <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> welcomes the commitments to changing these terms and practices made by Dixons Carphone plc, JustCloud and Livedrive. The <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> is talking to other companies in the sector and expects them to make similar improvements. Companies which do not comply with consumer law risk enforcement action.<\/p>\n<p>In addition to its report, the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> is today also publishing an <a href=\"https:\/\/www.gov.uk\/government\/publications\/letter-from-the-cma-to-cloud-storage-providers-on-consumer-law\">open letter<\/a> for businesses, which advises them to:<\/p>\n<ul>\n<li>review their terms to make sure they are fair for consumers<\/li>\n<li>ensure that consumers get necessary information before they buy<\/li>\n<\/ul>\n<p>The <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> has also published a <a href=\"https:\/\/www.gov.uk\/government\/publications\/cloud-storage-guide-for-consumers\">60-second summary<\/a> and 2 infographics on <a rel=\"external\" href=\"https:\/\/www.flickr.com\/photos\/cma-gov-uk\/27230961176\/in\/dateposted-friend\/\">choosing the right cloud storage service<\/a> and what <a rel=\"external\" href=\"https:\/\/www.flickr.com\/photos\/cma-gov-uk\/27231016296\/in\/dateposted-friend\/\">terms and conditions to look out for<\/a>.<\/p>\n<p>Top tips include:<\/p>\n<ul>\n<li>checking that the service meets your needs before you buy<\/li>\n<li>keeping an eye out for changes to the service<\/li>\n<li>challenging terms in the contract if you think they are unfair<\/li>\n<\/ul>\n<p>Nisha Arora, <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> Senior Director, Consumer, said:<\/p>\n<blockquote>\n<p>Cloud storage offers a convenient means of keeping family photos, favourite music and films and important documents safe, and accessing them quickly from any device.<\/p>\n<p>Our review found that people find these services really valuable. However, we also heard some complaints resulting from unfair terms in contracts. If left unchanged, these terms could result in people losing access to their treasured possessions or facing unexpected charges.<\/p>\n<p class=\"last-child\">In this rapidly-developing market, it\u2019s important that we act now to ensure that businesses comply with the law and that consumers\u2019 trust in these valuable services is maintained. This survey was carried out by Ipsos MORI between 7 and 29 January 2016 as part of its face-to-face omnibus survey, Capibus, which conducts interviews with 2,000 GB adults aged 15+ every week. It asked consumers who used cloud storage in a personal\/private capacity a range of questions about their experience of cloud storage.<\/li>\n<li>The <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> has not made a finding on whether cloud storage providers\u2019 terms and practices have breached consumer law. The <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> has not opened a formal investigation into any cloud storage provider on whether their practices could breach consumer law. Where there is evidence that practices breach consumer law this could lead to enforcement action by the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> or other enforcers. Only a court can decide whether a particular term or practice breaches the law.<\/li>\n<li>Individuals have rights under the Consumer Rights Act and can ask a court to consider whether a term is unfair and unenforceable. The <a rel=\"external\" href=\"https:\/\/www.citizensadvice.org.uk\/consumer\/get-more-help\/if-you-need-more-help-about-a-consumer-issue\/\">Citizens Advice consumer helpline<\/a> is a telephone, email and online service offering advice to consumers where they have a problem with goods and services in the UK. If you have a cross-border complaint, you can go to <a rel=\"external\" href=\"http:\/\/www.econsumer.gov\/\">www.econsumer.gov<\/a>.
