{"id":71114,"date":"2016-06-01T14:03:24","date_gmt":"2016-06-01T14:03:24","guid":{"rendered":"http:\/\/mostafa.openonline.co.uk\/?guid=9ad8739617521f90d00e2d3e1d1df644"},"modified":"2016-06-01T14:03:24","modified_gmt":"2016-06-01T14:03:24","slug":"news-story-cma-considers-undertakings-in-fruit-juice-merger","status":"publish","type":"post","link":"https:\/\/mostafa.openonline.co.uk\/?p=71114","title":{"rendered":"News story: CMA considers undertakings in fruit juice merger"},"content":{"rendered":"<div class=\"govspeak\">\n<p><abbr title=\"Hain Frozen Foods UK Limited\">Hain<\/abbr> Frozen Foods UK Limited (<abbr title=\"Hain Frozen Foods UK Limited\">Hain<\/abbr>) bought Orchard House Foods Limited in December 2015 and the Competition and Markets Authority (<abbr title=\"Competition and Markets Authority\">CMA<\/abbr>) <a href=\"https:\/\/www.gov.uk\/government\/news\/juice-merger-must-offer-undertakings-to-avoid-in-depth-inquiry\">announced on 17 May 2016<\/a> that the merger would be referred for an in-depth phase 2 investigation unless acceptable undertakings were offered.<\/p>\n<p>The companies are the only 2 suppliers of own-label freshly squeezed fruit juice to supermarket retailers. The companies are also 2 of the main suppliers of own-label freshly squeezed fruit juice to food service retailers such as cafes and restaurants, and face limited competition from other suppliers in this area. The <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> therefore believes that the merger raises competition concerns and could lead to higher prices of own-label freshly squeezed fruit juice for retailers and consumers.<\/p>\n<p><abbr title=\"Hain Frozen Foods UK Limited\">Hain<\/abbr> has now offered to sell its own-label freshly squeezed fruit juice business to a suitable purchaser and the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> considers that this undertaking, or a modified version of it, might be acceptable.<\/p>\n<p>The <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> will now consider whether to accept the proposed undertakings and will open a public consultation on whether they &#8211; and any proposed purchaser for the divestment business &#8211; are sufficient to address the competition concerns.
