{"id":71441,"date":"2016-06-16T11:16:00","date_gmt":"2016-06-16T11:16:00","guid":{"rendered":"http:\/\/mostafa.openonline.co.uk\/?guid=78e8ba5771a9c24cd5c34b9d64e72523"},"modified":"2016-06-16T11:16:00","modified_gmt":"2016-06-16T11:16:00","slug":"press-release-scottish-sales-required-after-records-management-merger","status":"publish","type":"post","link":"https:\/\/mostafa.openonline.co.uk\/?p=71441","title":{"rendered":"Press release: Scottish sales required after records management merger"},"content":{"rendered":"<div class=\"govspeak\">\n<p>In its <a href=\"https:\/\/www.gov.uk\/cma-cases\/iron-mountain-recall-merger-inquiry\">final report<\/a> published today, the Competition and Markets Authority (<abbr title=\"Competition and Markets Authority\">CMA<\/abbr>) has found that while the merged company will face sufficient competition in most of the UK, there will be fewer alternatives for customers of records and information management services (<abbr title=\"records and information management services\">RIMS<\/abbr>) in the Aberdeen and Dundee areas. The <a href=\"https:\/\/www.gov.uk\/government\/news\/records-management-merger-may-require-sales\">provisional findings<\/a>, which were published in May, had already identified competition concerns in these areas.<\/p>\n<p>The inquiry group of independent panel members investigating the merger has therefore concluded that, in order to preserve competition, Iron Mountain should sell Recall\u2019s existing operations in Aberdeen and Dundee, known as C21 Data Services. The buyer will need to be approved by the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> and will have to demonstrate that it has the capability to compete with Iron Mountain. Recall acquired C21 Data Services last year.<\/p>\n<p>Both companies provide <abbr title=\"records and information management services\">RIMS<\/abbr> in the UK \u2013 specifically records management services (<abbr title=\"records management services\">RMS<\/abbr>), which comprise the storage and retrieval of paper and hard copy records, and physical offsite data protection (<abbr title=\"offsite data protection\">OSDP<\/abbr>) services, which involve the storage and retrieval of data and media on tapes\/discs. The 2 companies operate from a total of 58 sites across the UK.<\/p>\n<p>The parties both provide <abbr title=\"records management services\">RMS<\/abbr> and physical <abbr title=\"offsite data protection\">OSDP<\/abbr> to national and local customers, and oil and gas customers with more specialist requirements, such as for storage of geological \u2018core\u2019 samples. The need to be able to access such stored information quickly means that customers require such facilities to be located nearby \u2013 generally within a 50-mile radius.<\/p>\n<p>The inquiry group found that in most areas of the UK where both companies are active, there are sufficient alternative suppliers to preserve competition and ensure that the merged company will be prevented from raising prices or otherwise reducing the level of service to customers.<\/p>\n<p>However in the Aberdeen and Dundee areas, the merged company would face fewer competitors with little prospect of new entry and expansion to counteract this. As such, the group identified a substantial lessening of competition in the supply of <abbr title=\"records management services\">RMS<\/abbr> and <abbr title=\"offsite data protection\">OSDP<\/abbr> services in the Aberdeen and Dundee areas \u2013 as well as in the supply of specialist <abbr title=\"records and information management services\">RIMS<\/abbr> services to oil and gas customers in the Aberdeen area.<\/p>\n<p>Anne Lambert, Inquiry Chair, said:<\/p>\n<blockquote>\n<p class=\"last-child\">We consider that the sale of Recall\u2019s operations in the Aberdeen and Dundee areas will provide a clear-cut way to address our concerns and ensure customers there still benefit from competition and choice.<\/p>\n<\/blockquote>\n<p>Full information on the merger investigation can be found on the <a href=\"https:\/\/www.gov.uk\/cma-cases\/iron-mountain-recall-merger-inquiry\">case page<\/a>.<\/p>\n<h3 id=\"notes-for-editors\">Notes for editors<\/h3>\n<ol>\n<li>The <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> is the UK\u2019s primary competition and consumer authority. Although the merger was completed in May 2016, \u2018hold separate\u2019 undertakings prevent Iron Mountain from integrating Recall\u2019s UK business until completion of the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr>\u2019s investigation.<\/li>\n<li>All the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr>\u2019s functions in phase 2 merger inquiries are performed by inquiry groups chosen from the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr>\u2019s panel members.
