{"id":72978,"date":"2016-08-03T16:44:22","date_gmt":"2016-08-03T16:44:22","guid":{"rendered":"http:\/\/mostafa.openonline.co.uk\/?guid=321c6606d342cc5d586dc7f1dfe9d320"},"modified":"2016-08-03T16:44:22","modified_gmt":"2016-08-03T16:44:22","slug":"news-story-civil-news-check-your-work-is-in-scope-before-claiming","status":"publish","type":"post","link":"https:\/\/mostafa.openonline.co.uk\/?p=72978","title":{"rendered":"News story: Civil news: check your work is in scope before claiming"},"content":{"rendered":"<div class=\"govspeak\">\n<p>There are a number of key areas where some simple checks will help you avoid making errors with your claims.<\/p>\n<h3 id=\"cost-limitation\">Cost limitation<\/h3>\n<p>Providers need to ensure that cost limitations cover the costs required.<\/p>\n<p>Payments cannot be made over the cost limitation for:<\/p>\n<ul>\n<li>payments on account<\/li>\n<li>payments under the Family Advocacy Scheme<\/li>\n<li>payments under the Family Graduated Fee Scheme<\/li>\n<\/ul>\n<p>Similarly, with work processed through Client and Cost Management System, we are unable to make payments to advocates where advocacy cost allocations are insufficient.<\/p>\n<h3 id=\"certificate-scope\">Certificate scope<\/h3>\n<p>You should only carry out work on proceedings covered by the certificate.<\/p>\n<p>Where there are additional proceedings, take care to ensure you are covered for this work.<\/p>\n<p>Where you are attending a final contested hearing, again, please make sure that your certificate covers this.<\/p>\n<h3 id=\"emergency-scope\">Emergency scope<\/h3>\n<p>Make sure that work carried out on an emergency certificate is within the emergency date range.<\/p>\n<p>Work undertaken after the emergency date range is \u2018at risk\u2019 pending the grant of a substantive certificate.<\/p>\n<p>Further guidance on this is in the electronic handbook \u2013 see below.<\/p>\n<h3 id=\"show-cause\">Show cause<\/h3>\n<p>For certificates issued under the Access to Justice Act, no work can be claimed for the period when there was a \u2018show cause\u2019 on the certificate.<\/p>\n<p>For certificates issued under the Legal Aid, Sentencing and Punishment of Offenders Act 2012, any work you carry out during the show cause period is \u2018at risk\u2019.<\/p>\n<p>If the show cause is removed, funding will be continuous \u2013 as though the show cause was never placed on the certificate.<\/p>\n<p>If the certificate is withdrawn, no work can be claimed from the date the show cause was placed on the certificate.<\/p>\n<p>Further information<\/p>\n<p><a href=\"https:\/\/www.gov.uk\/guidance\/funding-and-costs-assessment-for-civil-and-crime-matters\">Legal aid guidance<\/a> \u2013 to download \u2018electronic handbook\u2019<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Remember it is your responsibility to make sure your work is in scope.<\/p>\n","protected":false},"author":8,"featured_media":0,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[13],"tags":[],"_links":{"self":[{"href":"https:\/\/mostafa.openonline.co.uk\/index.php?rest_route=\/wp\/v2\/posts\/72978"}],"collection":[{"href":"https:\/\/mostafa.openonline.co.uk\/index.php?rest_route=\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/mostafa.openonline.co.uk\/index.php?rest_route=\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/mostafa.openonline.co.uk\/index.php?rest_route=\/wp\/v2\/users\/8"}],"replies":[{"embeddable":true,"href":"https:\/\/mostafa.openonline.co.uk\/index.php?rest_route=%2Fwp%2Fv2%2Fcomments&post=72978"}],"version-history":[{"count":0,"href":"https:\/\/mostafa.openonline.co.uk\/index.php?rest_route=\/wp\/v2\/posts\/72978\/revisions"}],"wp:attachment":[{"href":"https:\/\/mostafa.openonline.co.uk\/index.php?rest_route=%2Fwp%2Fv2%2Fmedia&parent=72978"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/mostafa.openonline.co.uk\/index.php?rest_route=%2Fwp%2Fv2%2Fcategories&post=72978"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/mostafa.openonline.co.uk\/index.php?rest_route=%2Fwp%2Fv2%2Ftags&post=72978"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
