{"id":76271,"date":"2016-11-18T14:01:54","date_gmt":"2016-11-18T14:01:54","guid":{"rendered":"http:\/\/mostafa.openonline.co.uk\/?guid=f1efc92424929165509db1da3c0b8a1e"},"modified":"2016-11-18T14:01:54","modified_gmt":"2016-11-18T14:01:54","slug":"news-story-cat-refers-leased-line-price-control-appeals-to-cma","status":"publish","type":"post","link":"https:\/\/mostafa.openonline.co.uk\/?p=76271","title":{"rendered":"News story: CAT refers leased line price control appeals to CMA"},"content":{"rendered":"<div class=\"govspeak\">\n<p>CityFibre Infrastructure Holdings plc (CityFibre) and TalkTalk Telecom Group Plc (TalkTalk) both appealed to the Competition Appeal Tribunal (<abbr title=\"Competition Appeal Tribunal\">CAT<\/abbr>) following <a rel=\"external\" href=\"https:\/\/www.ofcom.org.uk\/consultations-and-statements\/category-1\/business-connectivity-market-review-2015\">Ofcom\u2019s final decision in its Business Connectivity Market Review in April this year<\/a>.<\/p>\n<p>Leased lines are high-quality, dedicated, point-to-point data transmission services used by businesses and providers of communications services. Leased lines are most commonly rented by businesses or larger organisations from communications providers who, in turn, may purchase wholesale leased line services from BT.<\/p>\n<p>Under the 2003 Communications Act, if decisions by Ofcom are appealed to the <abbr title=\"Competition Appeal Tribunal\">CAT<\/abbr> and include a price control matter, then this matter must be referred to the Competition and Markets Authority (<abbr title=\"Competition and Markets Authority\">CMA<\/abbr>) for determination. Both companies have therefore sought a reference to the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> of the price control matters in their respective appeals.<\/p>\n<p>BT has also appealed against Ofcom\u2019s decision on non-price-control matters so its appeal will be dealt with by the <abbr title=\"Competition Appeal Tribunal\">CAT<\/abbr>.<\/p>\n<p>The <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> determination will be made by a group of independent panel members supported by a case team of <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> staff. The <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> has until 31 March 2017 to send its final determination to the <abbr title=\"Competition Appeal Tribunal\">CAT<\/abbr>.
