{"id":77610,"date":"2016-12-29T09:48:07","date_gmt":"2016-12-29T09:48:07","guid":{"rendered":"http:\/\/mostafa.openonline.co.uk\/?guid=aefef3fc3c809da8bb5b996c905c7dee"},"modified":"2016-12-29T09:48:07","modified_gmt":"2016-12-29T09:48:07","slug":"press-release-gym-users-to-get-better-deal-in-2017","status":"publish","type":"post","link":"https:\/\/mostafa.openonline.co.uk\/?p=77610","title":{"rendered":"Press release: Gym users to get better deal in 2017"},"content":{"rendered":"<div class=\"govspeak\">\n<p>Gym users have saved around \u00a337 million in recent years, following an investigation by the Competition and Markets Authority\u2019s (<abbr title=\"Competition and Markets Authority\">CMA<\/abbr>) predecessor.<\/p>\n<p>750,000 people have already directly benefited from this work, with contracts no longer tying gym users into multi-year deals, offering more choice and allowing cancellations. Other innovations have also emerged in this \u00a32.7 billion a year market, such as the rise of \u2018pay-as-you-go\u2019 memberships, further improving the offer available.<\/p>\n<p>Nisha Arora, Senior Director for Consumer Enforcement, said:<\/p>\n<blockquote>\n<p>It\u2019s great to see that gym-goers are already getting far better deals than they used to. Contracts no longer routinely run for more than a year, and are cancellable without hefty penalties if your circumstances change. Thanks to our predecessor\u2019s investigation the UK\u2019s 8.75 million active gym members are able to benefit from these improvements.<\/p>\n<p class=\"last-child\">If you\u2019re thinking about signing up to a gym in the New Year, don\u2019t forget to shop around to find the best deal for you \u2013 whether that be a pay-as-you-go or annual contract \u2013 and check your contract\u2019s length and cancellation policies, so you can stop paying if your circumstances change. We also want gyms to continue innovating and offering their customers competitive deals.<\/p>\n<\/blockquote>\n<p>The Office of Fair Trading (<abbr title=\"Office of Fair Trading\">OFT<\/abbr>) initially urged all gyms to check their contract terms were fair and lawful under consumer protection law, after the High Court ordered Ashbourne Management Services Limited not to use certain unfair terms in 2011 following complaints from certain members about lengthy contracts they could not cancel.<\/p>\n<p>Following a further investigation by the <abbr title=\"Office of Fair Trading\">OFT<\/abbr> in 2013, 6 other gym operators agreed to give members better cancellation rights and make their contract terms easier to understand. Twenty extra gyms were warned to review their terms and conditions and ensure that they were fair.<\/p>\n<p>Consumer Minister Margot James said:<\/p>\n<blockquote>\n<p class=\"last-child\">Gym-goers have already saved millions of pounds because of this work and thousands more are set to benefit as they look to get fit in the New Year. I would urge people to check the small print before locking themselves into long-term contracts.<\/p>\n<\/blockquote>\n<p>The <abbr title=\"Competition and Markets Authority\">CMA<\/abbr>, which has taken on some of the <abbr title=\"Office of Fair Trading\">OFT<\/abbr>\u2019s consumer enforcement powers, has now <a href=\"https:\/\/www.gov.uk\/government\/publications\/unfair-contract-terms-evaluation-of-oft-consumer-enforcement-case\">evaluated<\/a> the impact of the <abbr title=\"Office of Fair Trading\">OFT<\/abbr>\u2019s work and found that the industry had largely abandoned the terms the <abbr title=\"Office of Fair Trading\">OFT<\/abbr> challenged and the terms available to consumers are now fair and more advantageous. Around 750,000 gym members have directly benefited from the intervention, they have saved \u00a337 million and complaints about gyms have fallen significantly.<\/p>\n<p>The <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> is committed to ensuring that contracts do not unfairly lock in consumers or prevent them from switching providers, and has worked with a number of sectors including <a href=\"https:\/\/www.gov.uk\/cma-cases\/cloud-storage-consumer-compliance-review\">cloud storage<\/a>, <a href=\"https:\/\/www.gov.uk\/government\/news\/wedding-venues-advised-to-play-fair\">wedding and events<\/a> and <a href=\"https:\/\/www.gov.uk\/cma-cases\/consumer-protection-review-of-higher-education\">higher education<\/a> to improve terms and conditions. We also have several investigations running into complaints about potentially unfair terms and conditions, including in the <a href=\"https:\/\/www.gov.uk\/cma-cases\/online-gambling\">online gambling<\/a> and <a href=\"https:\/\/www.gov.uk\/cma-cases\/care-homes-market-study\">care homes<\/a> sectors.<\/p>\n<p>In addition to sector-specific guidance in these areas, the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> has also produced <a href=\"https:\/\/www.gov.uk\/government\/collections\/cma-consumer-enforcement-guidance\">short and simple guides<\/a> aimed at helping consumers and businesses to understand their rights and obligations under consumer law.<\/p>\n<h3 id=\"notes-for-editors\">Notes for editors<\/h3>\n<ol>\n<li>The <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> is the UK\u2019s primary competition and consumer authority. The <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> considered how gym contracts had changed following the <abbr title=\"Office of Fair Trading\">OFT<\/abbr> intervention and how much of that change could be attributed to the <abbr title=\"Office of Fair Trading\">OFT<\/abbr>. The benefits were then calculated by first estimating the number of consumers that benefited from the changes then how much each consumer would have saved over the period. By combining these figures, the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> reached its overall estimate of the benefits of the <abbr title=\"Office of Fair Trading\">OFT<\/abbr> intervention.
