{"id":80228,"date":"2017-03-30T11:47:34","date_gmt":"2017-03-30T11:47:34","guid":{"rendered":"http:\/\/mostafa.openonline.co.uk\/?guid=f489b458dcdc64b2a69d167f93d0827a"},"modified":"2017-03-30T11:47:34","modified_gmt":"2017-03-30T11:47:34","slug":"news-story-certainty-and-stability-for-uk-businesses-as-negotiations-begin-on-new-relationship-with-europe","status":"publish","type":"post","link":"https:\/\/mostafa.openonline.co.uk\/?p=80228","title":{"rendered":"News story: Certainty and stability for UK businesses as negotiations begin on new relationship with Europe"},"content":{"rendered":"<div class=\"govspeak\">\n<p>Giving maximum legal certainty for businesses, workers and investors as the <abbr title=\"United Kingdom\">UK<\/abbr> leaves the European Union is at the heart of Government plans published today.<\/p>\n<p>The day after the Prime Minister triggered Article 50 \u2014 starting the formal process of leaving the bloc \u2014 a <a href=\"https:\/\/www.gov.uk\/government\/publications\/the-great-repeal-bill-white-paper\">White Paper<\/a> on the Great Repeal Bill sets out the Government\u2019s approach to converting existing <abbr title=\"European Union\">EU<\/abbr> law into domestic law on the day we leave the <abbr title=\"European Union\">EU<\/abbr>.<\/p>\n<p>The paper sets out how the Great Repeal Bill will deliver a smooth and orderly exit from the <abbr title=\"European Union\">EU<\/abbr>, by:<\/p>\n<ul>\n<li>repealing the European Communities Act 1972 \u2014 returning power to <abbr title=\"United Kingdom\">UK<\/abbr> elected representatives and institutions;<\/li>\n<li>converting <abbr title=\"European Union\">EU<\/abbr> law into domestic law at the point of departure \u2014 giving certainty and allowing any changes to be made in a sensible, timely and considered fashion; and<\/li>\n<li>correcting <abbr title=\"European Union\">EU<\/abbr> law that will not function as it is converted into <abbr title=\"United Kingdom\">UK<\/abbr> law \u2014 ensuring the statute book operates effectively.<\/li>\n<\/ul>\n<p>This process will ensure that the same rules and laws will apply after we leave the <abbr title=\"European Union\">EU<\/abbr> as they did before, from the moment we leave. After the <abbr title=\"United Kingdom\">UK<\/abbr> has left the <abbr title=\"European Union\">EU<\/abbr> and sovereignty has returned to the <abbr title=\"United Kingdom\">UK<\/abbr> Parliament, it will be able to decide which elements of law to keep, change or repeal.<\/p>\n<p>Secretary of State for Exiting the <abbr title=\"European Union\">EU<\/abbr> David Davis said:<\/p>\n<blockquote>\n<p>This White Paper lays out a pragmatic and principled approach to converting <abbr title=\"European Union\">EU<\/abbr> law into <abbr title=\"United Kingdom\">UK<\/abbr> law on the day we leave the <abbr title=\"European Union\">EU<\/abbr> \u2014 giving businesses, workers and investors as much certainty as possible.<\/p>\n<p>It also means the negotiation over our future economic partnership with the <abbr title=\"European Union\">EU<\/abbr> will be unlike any other in history, because we will start from a point of exact equivalence.<\/p>\n<p>After that, it will be for Parliament to determine what <abbr title=\"European Union\">EU<\/abbr> legislation it wants to amend, repeal or improve \u2014 finally ending the supremacy of <abbr title=\"European Union\">EU<\/abbr> lawmakers.<\/p>\n<p class=\"last-child\">Our plan will also give the <abbr title=\"United Kingdom\">UK<\/abbr> Parliament and the devolved legislatures the ability to make changes to law where necessary, so that our legal system continues to operate correctly on exit day.<\/p>\n<\/blockquote>\n<p>The White Paper, called \u2018Legislating for the United Kingdom\u2019s withdrawal from the European Union\u2019, makes clear that existing workers\u2019 legal rights will continue to be guaranteed in law.<\/p>\n<p>A significant proportion of existing <abbr title=\"European Union\">EU<\/abbr> law will cease to work properly without changes being made.<\/p>\n<p>To enable these laws to function properly on exit, providing certainty and stability, the Government needs to undertake a programme of legislation to correct the statute book while Article 50 negotiations take place.<\/p>\n<p>The White Paper sets out how the Government will look to address those issues through a new time limited correcting power, to apply before the <abbr title=\"United Kingdom\">UK<\/abbr> leaves the <abbr title=\"European Union\">EU<\/abbr> and for a limited period afterwards.<\/p>\n<p>This will enable changes through secondary legislation, and ensure there is a smooth transition as <abbr title=\"European Union\">EU<\/abbr> law becomes <abbr title=\"United Kingdom\">UK<\/abbr> law.<\/p>\n<p>Enabling technical changes to be made quickly will also allow for Parliament to have the appropriate amount of time to fully scrutinise substantive policy changes that require primary legislation, such as new Immigration and Customs Bills.<\/p>\n<p>And the White Paper proposes there is a time limit on the power to make changes through secondary legislation.<\/p>\n<p>The Government plans also makes clear that during this process, no decisions currently taken by the devolved administrations will be removed from them.<\/p>\n<p>The Government will use this opportunity to make sure more decisions are devolved \u2014 and Ministers in Scotland, Wales and Northern Ireland will be given the same powers to fix broken laws in devolved legislation.<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>The Great Repeal Bill White Paper was published today.
