{"id":80649,"date":"2017-04-10T12:23:18","date_gmt":"2017-04-10T12:23:18","guid":{"rendered":"http:\/\/mostafa.openonline.co.uk\/?guid=9d31bf4f53f6926fa4de8fc897f9ce63"},"modified":"2017-04-10T12:23:18","modified_gmt":"2017-04-10T12:23:18","slug":"news-story-cma-determination-published-in-telecoms-appeals-3","status":"publish","type":"post","link":"https:\/\/mostafa.openonline.co.uk\/?p=80649","title":{"rendered":"News story: CMA determination published in telecoms appeals"},"content":{"rendered":"<div class=\"govspeak\">\n<p>In November 2016, the Competition Appeal Tribunal (<abbr title=\"Competition Appeal Tribunal\">CAT<\/abbr>) <a href=\"https:\/\/www.gov.uk\/government\/news\/cat-refers-leased-line-price-control-appeals-to-cma\">referred 2 appeals<\/a> to the Competition and Markets Authority (<abbr title=\"Competition and Markets Authority\">CMA<\/abbr>) over the amount British Telecommunications plc (<abbr title=\"British Telecommunications plc\">BT<\/abbr>) is permitted to charge other providers for purchasing leased line services.<\/p>\n<p>CityFibre Infrastructure Holdings plc (CityFibre) and TalkTalk Telecom Group Plc (TalkTalk) both appealed to the <abbr title=\"Competition Appeal Tribunal\">CAT<\/abbr> following the Office of Communications\u2019 (Ofcom\u2019s) final decision in its Business Connectivity Market Review (<abbr title=\"Business Connectivity Market Review\">BCMR<\/abbr>) in <a rel=\"external\" href=\"https:\/\/www.ofcom.org.uk\/consultations-and-statements\/category-1\/business-connectivity-market-review-2015\">April last year<\/a>.<\/p>\n<p>Leased lines are high-quality, dedicated, point-to-point data transmission services used by businesses and providers of communications services. Leased lines are most commonly rented by businesses or larger organisations from communications providers who, in turn, may purchase wholesale leased line services from <abbr title=\"British Telecommunications plc\">BT<\/abbr>.<\/p>\n<p>In its final determination on the TalkTalk appeal published by the <abbr title=\"Competition Appeal Tribunal\">CAT<\/abbr> today (and also available on <a href=\"https:\/\/www.gov.uk\/cma-cases\/leased-lines-price-control-appeals-cityfibre-and-talktalk\">the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr>\u2019s case page<\/a>, the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> has said that Ofcom made an error in the methodology used for calculating the price for Dark Fibre Access. It has given guidance to the <abbr title=\"Competition Appeal Tribunal\">CAT<\/abbr> that the decision should be remitted to Ofcom and that Ofcom should amend its methodology in light of the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr>\u2019s findings.<\/p>\n<p>The <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> dismissed the challenge in the CityFibre appeal.<\/p>\n<p>Under the <a rel=\"external\" href=\"http:\/\/www.legislation.gov.uk\/ukpga\/2003\/21\/contents\">2003 Communications Act<\/a>, if decisions by Ofcom are appealed to the <abbr title=\"Competition Appeal Tribunal\">CAT<\/abbr> and include a price control matter, then this matter must be referred to the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> for determination. Both companies therefore sought a reference to the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> of the price control matters in their respective appeals. Certain non-price control matters in relation to the <abbr title=\"Business Connectivity Market Review\">BCMR<\/abbr> are also being dealt with by the <abbr title=\"Competition Appeal Tribunal\">CAT<\/abbr> in appeals brought by <abbr title=\"British Telecommunications plc\">BT<\/abbr> and CityFibre.<\/p>\n<p>The <a href=\"https:\/\/www.gov.uk\/cma-cases\/leased-lines-price-control-appeals-cityfibre-and-talktalk\">determination<\/a> was made by a group of independent panel members supported by a case team of <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> staff.<\/p>\n<p>The <abbr title=\"Competition Appeal Tribunal\">CAT<\/abbr> is required to determine the specified price control matters in accordance with the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr>\u2019s findings, unless the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr>\u2019s determination is set aside on judicial review grounds.
