{"id":82092,"date":"2017-06-30T10:00:53","date_gmt":"2017-06-30T10:00:53","guid":{"rendered":"http:\/\/mostafa.openonline.co.uk\/?guid=6cd8541b09085b51e1ed304f0af68006"},"modified":"2017-06-30T10:00:53","modified_gmt":"2017-06-30T10:00:53","slug":"news-story-cma-consults-on-leniency-applications-in-regulated-sectors","status":"publish","type":"post","link":"https:\/\/mostafa.openonline.co.uk\/?p=82092","title":{"rendered":"News story: CMA consults on leniency applications in regulated sectors"},"content":{"rendered":"<div class=\"govspeak\">\n<p>A proposed information note sets out the arrangements for the handling of leniency applications in the context of the concurrency regime between the Competition and Markets Authority (<abbr title=\"Competition and Markets Authority\">CMA<\/abbr>) and those sector regulators with full membership of the <a href=\"https:\/\/www.gov.uk\/government\/groups\/uk-competition-network\">UK Competition Network<\/a>: Ofcom, Ofgem, Ofwat, Financial Conduct Authority, Office of Rail and Road, Civil Aviation Authority, and the Payment Systems Regulator.<\/p>\n<p>These sector regulators have concurrent powers with the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> to enforce competition law in their respective sectors, and to impose financial penalties when the law has been broken. When setting any penalty, the <abbr title=\"Competition and Markets Authority\">CMA<\/abbr> and the sectoral regulators are required to have regard to the published <a href=\"https:\/\/www.gov.uk\/government\/publications\/appropriate-ca98-penalty-calculation\"><abbr title=\"Competition and Markets Authority\">CMA<\/abbr> guidance<\/a>.<\/p>\n<p>The <abbr title=\"Competition and Markets Authority\">CMA<\/abbr>\u2019s guidance includes provision for granting reduced penalties to companies who come forward with information on cartel activity, and who then co-operate fully with any subsequent investigation. The first company to apply for leniency can receive a 100% reduction in the penalty and successive applicants may receive deductions of up to 50%, depending on the added value of the material they provide. As cartels can be difficult to detect, leniency applications play an important role in uncovering this illegal activity.<\/p>\n<p>The information note reflects that informal arrangements have been in place to date and have operated on a case-by-case basis.
