These include new disqualification reasons for trustees and some charity senior manager positions (chief executives and finance directors &#8211; and those in equivalent roles).<\/p>\n<p>New reasons for disqualification include being in contempt of court, being named under particular anti-terrorism legislation or being on the sex offenders register.<\/p>\n<h2 id=\"individuals\">Individuals<\/h2>\n<p>If you\u2019re a trustee or senior manager (at CEO or finance director level) at a charity, check if you are disqualified by reading the <a href=\"https:\/\/www.gov.uk\/guidance\/automatic-disqualification-rules-for-charity-trustees-and-charity-senior-positions\">guidance for individuals<\/a>.<\/p>\n<p>If you are disqualified this guidance explains what you need to do and how to apply for a waiver.<\/p>\n<h2 id=\"charities\">Charities<\/h2>\n<p>Make sure you read the <a href=\"https:\/\/www.gov.uk\/guidance\/automatic-disqualification-rule-changes-guidance-for-charities\">guidance for charities<\/a>. This guide also includes a handy disqualifying reasons table that you can download.<\/p>\n<p>Ask your trustees and senior managers (at chief executive or finance director level) to confirm that they are not disqualified.<\/p>\n<p>We\u2019ve produced sample declarations for senior managers and trustees to state that they are not disqualified from acting in these positions. You can download these from the <a href=\"https:\/\/www.gov.uk\/guidance\/automatic-disqualification-rule-changes-guidance-for-charities#what-your-charity-needs-to-do\">guidance for charities<\/a>.<\/p>\n<p>If someone is disqualified, tell them that they can apply to have their disqualification waived.
