{"id":91411,"date":"2018-04-26T11:29:54","date_gmt":"2018-04-26T11:29:54","guid":{"rendered":"http:\/\/mostafa.openonline.co.uk\/?guid=b95e5c8814dde7da71ad9a0b8b9cb098"},"modified":"2018-04-26T11:29:54","modified_gmt":"2018-04-26T11:29:54","slug":"news-story-civilcrime-news-list-of-individuals-excluded-from-contract-work","status":"publish","type":"post","link":"https:\/\/mostafa.openonline.co.uk\/?p=91411","title":{"rendered":"News story: Civil\/crime news: list of individuals excluded from contract work"},"content":{"rendered":"<div class=\"govspeak\">\n<p>A list of individuals excluded from being supervisors or performing contract work is available on our \u2018contract terminations and exclusions\u2019 page on GOV.UK \u2013 link below.<\/p>\n<p>The information includes the:<\/p>\n<ul>\n<li>\n<p>individual\u2019s name<\/p>\n<\/li>\n<li>\n<p>region in which the individual was working prior to exclusion<\/p>\n<\/li>\n<li>\n<p>nature of work individual excluded from doing<\/p>\n<\/li>\n<li>\n<p>date exclusion was imposed<\/p>\n<\/li>\n<li>\n<p>date exclusion will be reviewed<\/p>\n<\/li>\n<\/ul>\n<h3 id=\"reasons-for-exclusion\">Reasons for exclusion<\/h3>\n<p>Among other reasons which are set out in our standard contract documents, the LAA may exclude individuals where they have been:<\/p>\n<ul>\n<li>\n<p>a cause of, or the subject of an official investigation or report \u2013 as defined within the applicable LAA contract standard terms<\/p>\n<\/li>\n<li>\n<p>a cause of a sanction, or<\/p>\n<\/li>\n<li>\n<p>they have been charged with, or convicted of, an imprisonable offence<\/p>\n<\/li>\n<\/ul>\n<p>In addition, we would need to consider that such action is reasonably necessary to protect clients, public funds or the LAA from material harm.<\/p>\n<h3 id=\"why-is-this-happening-now\">Why is this happening now?<\/h3>\n<p>By publishing a list, our intention is to raise awareness and reduce the risk of legal aid providers using any excluded individuals for work affected by the terms of their exclusion.<\/p>\n<h3 id=\"right-of-appeal\">Right of appeal<\/h3>\n<p>Details of excluded individuals will only be published following the conclusion of any applicable LAA appeal processes.<\/p>\n<h3 id=\"removing-individuals-from-the-list\">Removing individuals from the list<\/h3>\n<p>The individual will be removed from the published list once the exclusion expires or is revoked and the LAA is satisfied that the individual no longer poses a risk of causing material harm to clients\u2019 interests, public funds or the LAA.<\/p>\n<p>Individuals are entitled to apply annually for a review of their inclusion on the list or should their circumstances change such that the exclusion may no longer be considered necessary.<\/p>\n<h3 id=\"providers-to-check-excluded-individuals-list\">Providers to check \u2018excluded individuals\u2019 list<\/h3>\n<p>To ensure that providers are not in breach of their contractual obligations, it is the responsibility of providers to check the \u2018excluded individuals\u2019 list before allowing individuals or third parties to carry out contract work on their behalf.<\/p>\n<p>Obligations are set out in clause 10.4 of the contract standard terms \u2013 see contract link below.
