{"id":92359,"date":"2018-05-29T12:49:17","date_gmt":"2018-05-29T12:49:17","guid":{"rendered":"http:\/\/mostafa.openonline.co.uk\/?guid=a9a907edc55b08741ed92f5858ecdb2d"},"modified":"2018-05-29T12:49:17","modified_gmt":"2018-05-29T12:49:17","slug":"news-story-supplementary-protection-certificates-call-for-views","status":"publish","type":"post","link":"https:\/\/mostafa.openonline.co.uk\/?p=92359","title":{"rendered":"News story: Supplementary protection certificates: call for views"},"content":{"rendered":"<div class=\"govspeak\">\n<p>The European Commission is proposing a new exception from infringement of supplementary protection certificates (<abbr title=\"supplementary protection certificates\">SPC<\/abbr>), which protect medicines. <abbr title=\"supplementary protection certificates\">SPCs<\/abbr> are national <abbr title=\"intellectual property\">IP<\/abbr> rights provided for by <abbr title=\"European Union\">EU<\/abbr> regulations. A draft <a rel=\"external\" href=\"https:\/\/ec.europa.eu\/docsroom\/documents\/29462\">proposal for a Regulation<\/a> was published on 28 May 2018. This Regulation aims to amend <a rel=\"external\" href=\"https:\/\/ec.europa.eu\/health\/sites\/health\/files\/files\/eudralex\/vol-1\/reg_469_2009\/reg_469_2009_en.pdf\">Regulation (EC) No 469\/2009<\/a> concerning the supplementary protection certificate for medicinal products.<\/p>\n<p>The proposed waiver introduces a limited exception to the current system. It applies to <abbr title=\"supplementary protection certificates\">SPC<\/abbr> medicinal products manufactured in the <abbr title=\"European Union\">EU<\/abbr>. It allows their manufacture for export outside of the <abbr title=\"European Union\">EU<\/abbr>. Such activities would currently infringe an <abbr title=\"supplementary protection certificates\">SPC<\/abbr>. The draft Regulation also introduces measures intended to promote transparency and reduce the risk of diversion of <abbr title=\"intellectual property\">IP<\/abbr>-infringing products onto the <abbr title=\"European Union\">EU<\/abbr> market.<\/p>\n<p>The European Commission has issued a <a rel=\"external\" href=\"http:\/\/europa.eu\/rapid\/press-release_IP-18-3907_en.htm\">press release<\/a> outlining why there is a need for an <abbr title=\"supplementary protection certificates\">SPC<\/abbr> waiver.<\/p>\n<p>The <abbr title=\"Intellectual Property Office\">IPO<\/abbr> welcomes views on the draft legislative proposal. For example, evidence on the possible impact of the legislation for the <abbr title=\"United Kingdom\">UK<\/abbr>, views on the draft legal text and comments on the <a rel=\"external\" href=\"https:\/\/ec.europa.eu\/docsroom\/documents\/29463\">Commission\u2019s impact assessment<\/a>.<\/p>\n<p>Evidence should be clear and verifiable in line with our <a rel=\"external\" href=\"https:\/\/assets.publishing.service.gov.uk\/government\/uploads\/system\/uploads\/attachment_data\/file\/510985\/Guide_to_evidence_for_policy.pdf\">Guide to Evidence for Policy<\/a>.<\/p>\n<p>It would be helpful to receive views before the end of June 2018 to help inform working group discussions on the proposal between <abbr title=\"European Union\">EU<\/abbr> member states which may take place midsummer.
